3. Legal Basis for Processing
OrbitalForgeLabs processes personal data under the following legal bases as defined by the EU General Data Protection Regulation (GDPR):
- Consent (Article 6.1.a): Where you have explicitly agreed to the processing of your data for specific purposes, such as receiving marketing communications or accepting non-essential cookies.
- Contractual Necessity (Article 6.1.b): Where processing is required to fulfill a contract with you or to take pre-contractual steps at your request, including project scoping, service delivery, and payment processing.
- Legitimate Interest (Article 6.1.f): Where processing is necessary for our legitimate interests in maintaining website security, improving service quality, and preventing fraud, provided these interests are not overridden by your fundamental rights.
- Legal Obligation (Article 6.1.c): Where processing is required to comply with applicable Spanish and EU law, including tax record retention and regulatory reporting requirements.
4. How We Use Your Data
Your personal data is processed for the following purposes:
- Responding to inquiries and providing requested project proposals and technical specifications.
- Executing and managing contracted web development services and deliverables.
- Processing payments and maintaining accurate financial records as required by Spanish tax law.
- Maintaining website functionality, security, and performance through essential technical operations.
- Sending service-related communications regarding active projects, system updates, or maintenance windows.
- Complying with legal obligations, resolving disputes, and enforcing our service agreements.
5. Data Retention
OrbitalForgeLabs retains personal data only for as long as necessary to fulfill the purposes for which it was collected:
- Contact Form Data: Retained for 24 months from the date of submission, after which it is permanently deleted from active systems.
- Project Data: Retained for the duration of the active engagement plus 6 years, in compliance with Spanish commercial record-keeping requirements.
- Financial Records: Retained for 4 years as required by Spanish tax legislation (Ley General Tributaria).
- Technical Logs: Server access logs are automatically purged after 90 days. Analytics data is aggregated and anonymized after 26 months.
- Cookie Data: Session cookies expire at browser close. Persistent cookies are set to a maximum duration of 12 months, with renewal requiring fresh consent.
6. Data Sharing and Transfers
We do not sell, rent, or commercially exploit your personal data. Data may be shared with the following categories of recipients solely for the stated purposes:
- Hosting Infrastructure: Server data is processed within EU-based data centers. No personal data is transferred outside the European Economic Area without appropriate safeguards.
- Payment Processors: Payment data is processed through PCI-DSS compliant third-party payment infrastructure. OrbitalForgeLabs does not store full payment card details.
- Legal Authorities: Data may be disclosed to competent authorities when required by law, court order, or regulatory obligation under Spanish jurisdiction.
7. Your Rights Under GDPR
As a data subject under the EU General Data Protection Regulation, you have the following rights:
- Right of Access (Article 15): Request a copy of all personal data we hold about you.
- Right to Rectification (Article 16): Request correction of inaccurate or incomplete personal data.
- Right to Erasure (Article 17): Request deletion of your personal data, subject to legal retention obligations.
- Right to Restriction (Article 18): Request limitation of processing in specific circumstances.
- Right to Data Portability (Article 20): Receive your personal data in a structured, machine-readable format.

Refund Policy

OrbitalForgeLabs is committed to delivering high-quality web development and digital systems services. This refund policy outlines the conditions under which refunds may be issued for services contracted through our platform.
1. General Refund Terms
All refund requests are evaluated on a case-by-case basis in accordance with the project milestones, deliverables completed, and the terms specified in the individual service agreement. OrbitalForgeLabs operates a milestone-based payment structure, and refunds are processed relative to the specific milestone in question.
2. Cancellation Before Project Initiation
If a project is cancelled before any work has commenced (defined as within 48 hours of contract signing and before the System Reconnaissance phase), a full refund of any advance payments will be issued within 14 business days. Cancellations must be submitted in writing to [email protected].
3. Partial Refunds During Active Projects
If a project is cancelled after work has commenced but before completion, the following conditions apply:
- All milestones that have been completed and delivered are considered non-refundable, as the associated work has been performed and resources expended.
- For the current milestone in progress, a partial refund may be issued proportional to the percentage of work remaining, at the sole discretion of OrbitalForgeLabs.
- Any advance payments for future milestones that have not yet been initiated will be refunded in full within 14 business days.
- Administrative and setup fees (if specified in the service agreement) are non-refundable once charged.
4. Non-Refundable Items
The following are expressly non-refundable:
- Third-party licensing fees, domain registrations, hosting prepayments, or API subscription costs incurred on behalf of the client.
- Work completed during the Architectural Blueprint or System Reconnaissance phases, as these represent intellectual property delivery and strategic planning services.
- Post-delivery modifications, feature additions, or scope expansions requested after the final handoff has been confirmed in writing.
- Services rendered under fixed-price agreements where the deliverables have been substantially completed as specified.
5. Service Quality Disputes
If you believe that delivered work does not meet the specifications outlined in the service agreement, you must notify OrbitalForgeLabs in writing within 14 days of delivery. Upon receipt of a quality dispute, we will conduct a technical review within 5 business days. If the dispute is found to be valid, we will either remediate the delivered work to meet specifications or issue a partial refund proportional to the deviation from agreed specifications.
6. Refund Processing
All approved refunds are processed within 14 business days using the original payment method. Refund processing times may vary depending on the payment provider and banking institution. OrbitalForgeLabs will provide a refund confirmation and transaction reference upon processing.
7. Governing Law
This refund policy is governed by the laws of Spain. Any disputes arising from this policy shall be resolved through the competent courts of Ávila, Spain. This policy does not affect your statutory rights under Spanish consumer protection legislation.
Terms of Service

These Terms of Service ("Terms") govern the use of web development, digital systems, and consulting services provided by OrbitalForgeLabs ("Company," "we," "us"), registered at Calle de los Hornos Caleros 64, 1, Piso 5, 1 A, Ávila, Spain. By engaging our services, you ("Client," "you") agree to be bound by these Terms.
1. Scope of Services
OrbitalForgeLabs provides professional web development, interface engineering, API infrastructure design, performance optimization, SEO technical services, and digital brand system construction. The specific scope, deliverables, timeline, and pricing for each engagement are defined in the individual Service Agreement ("SOW") issued prior to project initiation. These Terms apply to all engagements unless expressly modified in the SOW.
2. Project Initiation and Onboarding
Upon acceptance of a proposal, OrbitalForgeLabs will initiate the System Reconnaissance phase. Project commencement requires: (a) signed Service Agreement, (b) initial payment as specified in the SOW, and (c) delivery of all required client-side materials, assets, and access credentials as outlined in the onboarding checklist. Delays in client-side delivery will result in proportional timeline extensions.
3. Payment Terms
- Payments are structured according to the milestone schedule defined in each SOW.
- Invoices are issued upon milestone completion and are payable within 14 calendar days.
- Late payments incur a 2% monthly interest charge on the outstanding balance, compounded monthly, in accordance with Spanish commercial law.
- Work on subsequent milestones may be suspended if a milestone payment remains unpaid for more than 21 days.
- All prices are quoted in Euros (€) and are exclusive of applicable Spanish VAT (IVA), which will be added at the prevailing rate.
4. Intellectual Property
Upon full payment of all fees associated with a project, OrbitalForgeLabs grants the Client a perpetual, non-exclusive, royalty-free license to use all deliverables produced under the SOW. OrbitalForgeLabs retains the right to use general methodologies, frameworks, and non-proprietary tools developed during the engagement. Client-specific code, designs, and configurations are assigned to the Client upon final payment. Pre-existing intellectual property and third-party components remain subject to their original licensing terms.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This includes business strategies, technical specifications, source code, client data, and financial information. Confidentiality obligations survive the termination of the engagement for a period of 3 years, except where disclosure is required by law or regulatory obligation under Spanish jurisdiction.
6. Limitation of Liability
To the maximum extent permitted by applicable Spanish and EU law, OrbitalForgeLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total aggregate liability for any claim arising from or related to a specific engagement shall not exceed the total fees paid by the Client under the applicable SOW. This limitation does not apply to damages resulting from gross negligence, willful misconduct, or breaches of confidentiality obligations.
7. Warranties and Disclaimers
OrbitalForgeLabs warrants that all services will be performed in a professional and workmanlike manner, consistent with industry standards for web development. We warrant that deliverables will conform to the specifications defined in the applicable SOW at the time of delivery. We do not warrant that deliverables will be error-free, uninterrupted, or compatible with all third-party systems not explicitly identified in the SOW. Software vulnerabilities discovered after delivery will be addressed within the scope of any agreed maintenance agreement or as a separate engagement.
8. Termination
Either party may terminate a Service Agreement with 14 days' written notice. In the event of termination, the Client is obligated to pay for all work completed and accepted up to the termination date. OrbitalForgeLabs will deliver all completed work product within 7 business days of termination confirmation. Sections relating to Confidentiality, Intellectual Property, Limitation of Liability, and Governing Law survive termination.
9. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, telecommunications failures, or power outages. The affected party must provide prompt written notice and use commercially reasonable efforts to mitigate the impact.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Spain. Any dispute arising from these Terms or any Service Agreement shall first be submitted to good-faith mediation. If mediation fails within 30 days, disputes shall be resolved through binding arbitration administered under Spanish arbitration law, with proceedings held in Ávila, Spain. Nothing in this section prevents either party from seeking injunctive relief in the competent courts of Ávila.
11. Amendments
OrbitalForgeLabs reserves the right to amend these Terms of Service at any time. Material changes will be communicated to active Clients via email with a minimum 30-day notice period. Continued engagement after the notice period constitutes acceptance of the amended Terms. Current versions of these Terms are always accessible at this URL.
